Damages Are Key

When considering a civil case, of any sort, damages are extremely important.  In truth, an experienced attorney is the one who is best suited to determine damages.  Without a proper evaluation, your case will not hold water in the end.  It is possible that you may win a case on liability – meaning that the other side did a wrong to you – yet, there are no damages and thus no value at the end.  There are myriad of different kinds of damages, some examples are:

  • Injury
  • Loss of earnings
  • Specific performance
  • Compensation for a loss

When you have suffered and wish to be made complete again – that is where the damage evaluation comes into play.  The reason damages are so critical, is that the loss gives you leverage and a goal.  A case is framed based off what the client wants to happen at the end.  It is critical to have damages evaluated by an experienced and knowledgeable attorney.  Without the experience or knowledge, you risk low-balling demands and losing the maximum value of your case.  The evaluation of damages on the state and federal level varies drastically.  It may happen, that you become involved in a civil case and spend a considerable amount of time and money, only to receive pennies on the dollar because you did not have an experienced attorney to evaluate the damages in the case.
