I regularly go up against large corporations and municipalities.  As such, I am fighting some of the largest and well established law firms for my clients.  Amazingly, I find many of these firms do not live up to their name.

Generally, an associate attorney, who may have come from a big-name law school, is the true lead attorney on the case.  The extremely important task of Motion Practice is primarily in the newer attorney’s lap.  The partners, many of whom have never tried a case of any kind, sit in an ivory tower of disinterest.   They simply take the credit for the work done by others or verbally direct the research needed. 

As such, responses and motions to dismiss are woefully submitted to the court.  They are not being written from the global perspective that experience brings to the table.  Rather, they are treated as tasks on the way to please a higher-up.  I am finding that if these firms and organizations win, it is in spite of their effort, not because of it. Experience and an interest in the client’s case is rarely true in the big firm context.

However, when you have the experience to know there is something past the motion.  That motions are an important tool, but rarely the entirety of the case.  You write better and with purpose.  You know that a trial is on the horizon and that your advisory cannot match your advocacy.  That is why experience is key to winning.  Experience that the Law Office of Jacob Z. Weinstein, PLLC offers to each client.  Experience that allows one to be a monster in the courtroom.
